Verification of a creator does not relieve that creator of responsibility for verifying every other performer appearing in submitted content.

5. USER AND CREATOR CONDUCT

Users and creators are responsible for their activities on CherryVelvetX and for all content submitted through their accounts.

You may not use CherryVelvetX to upload, publish, transmit, distribute, promote, request, advertise, or otherwise make available content or activity that:

• violates applicable federal, state, local, or international law;
• infringes copyrights, trademarks, publicity rights, privacy rights, or other intellectual-property rights;
• contains malware, viruses, malicious code, or other technology intended to damage, monitor, interfere with, or gain unauthorized access to systems or information;
• contains another person’s private information without authorization;
• involves fraud, impersonation, deceptive practices, or unauthorized account access;
• depicts or promotes unlawful violence, exploitation, trafficking, or abuse;
• depicts sexual activity involving animals;
• depicts sexual violence, rape, or non-consensual sexual activity presented as actual conduct;
• depicts death, snuff material, torture, or other unlawful extreme content;
• involves any person under eighteen (18); or
• otherwise exposes CherryVelvetX or its users to criminal or unlawful activity.

CherryVelvetX reserves the right to determine whether content or conduct violates these Terms and may restrict access to or remove content when necessary.

6. INTELLECTUAL PROPERTY

Except for Creator Content and other User Submissions, the CherryVelvetX Website and its original software, design, graphics, branding, logos, text, interface elements, databases, and other proprietary materials are owned by or licensed to CherryVelvetX and are protected by applicable intellectual-property laws.

No ownership interest in CherryVelvetX intellectual property is transferred to users by their use of the Website.

Users may not reproduce, scrape, copy, distribute, modify, sell, license, reverse engineer, circumvent security measures, or commercially exploit CherryVelvetX proprietary materials without authorization.

Nothing in these Terms transfers ownership of a creator’s original content to CherryVelvetX.

7. CREATOR CONTENT AND USER SUBMISSIONS

CherryVelvetX permits authorized creators to submit photographs, videos, text, promotional material, and other content (“Creator Content”).

Creators retain ownership of their Creator Content.

Uploading Creator Content to CherryVelvetX does not transfer copyright ownership to CherryVelvetX.

By uploading Creator Content, however, the creator grants CherryVelvetX a non-exclusive, worldwide, royalty-free license to host, store, reproduce, process, display, stream, transmit, distribute, resize, format, and otherwise technically use the content as reasonably necessary to operate, secure, maintain, and promote CherryVelvetX and the creator’s presence on the Website.

This license does not give CherryVelvetX ownership of the Creator Content.

Unless separately authorized by the creator, CherryVelvetX will not sell ownership of Creator Content to another party.

The creator represents and warrants that they possess all rights, licenses, releases, permissions, and consents necessary to submit and authorize CherryVelvetX to display the content.

For every identifiable performer appearing in adult Creator Content, the uploading creator represents and warrants that:

1. every performer was at least eighteen (18) years old when the content was created;
2. every performer voluntarily consented to participating in the content;
3. every performer consented to the recording and distribution of the content;
4. the creator possesses all necessary releases and permissions;
5. the creator has complied with applicable recordkeeping requirements; and
6. the content does not violate applicable law.

CherryVelvetX may request documentation supporting these representations at any time.

Failure or refusal to provide requested documentation may result in removal of the content or suspension or termination of the creator’s account.

8. CREATOR INDEPENDENCE

Unless CherryVelvetX and a creator expressly enter into a separate written agreement stating otherwise, creators are independent users of the platform.

Nothing in these Terms creates an employment, partnership, joint venture, agency, fiduciary, talent-management, or similar relationship between CherryVelvetX and a creator.

Creators determine the content they produce, subject to these Terms and applicable law.

CherryVelvetX does not acquire ownership of a creator’s business, brand, likeness, social-media accounts, external subscription accounts, or Creator Content merely because the creator uses the Website.

9. ADVERTISING AND PLATFORM MONETIZATION

CherryVelvetX may generate revenue through advertising, sponsorships, promotional placements, affiliate relationships, traffic monetization, or other lawful methods.

Advertisements may appear on creator pages, content pages, or other areas of the Website.

Unless CherryVelvetX and a creator expressly agree otherwise in writing, advertising revenue generated by CherryVelvetX’s advertising inventory belongs to CherryVelvetX.

The presence of an advertisement does not necessarily constitute CherryVelvetX’s endorsement of the advertiser, product, or service.

CherryVelvetX is not responsible for transactions between users and third-party advertisers.

10. EXTERNAL CREATOR LINKS AND SERVICES

CherryVelvetX may permit creators to provide links to authorized third-party websites, social-media profiles, subscription platforms, stores, messaging services, or other external services.

Any transaction occurring entirely through a third-party service is governed by that third party’s terms and policies.

Unless expressly stated otherwise, CherryVelvetX is not a party to those transactions and is not responsible for payment disputes, refunds, subscriptions, chargebacks, content delivery, account suspensions, or other issues arising from third-party platforms.

11. PROHIBITED CONTENT — ZERO TOLERANCE

CherryVelvetX maintains zero tolerance for child sexual abuse material (“CSAM”) and other illegal sexual exploitation.

No person may upload, request, distribute, promote, link to, describe for purposes of solicitation, or otherwise facilitate content involving a person under eighteen (18).

Content involving actual or suspected CSAM will be removed or disabled when identified.

CherryVelvetX may preserve relevant information and report suspected CSAM or other unlawful exploitation to the National Center for Missing & Exploited Children (NCMEC), law enforcement, or other appropriate authorities when required by applicable law.

CherryVelvetX also prohibits actual content involving sexual trafficking, non-consensual sexual activity, sexual activity involving animals, and other unlawful sexual exploitation.

12. CONTENT MODERATION AND REMOVAL

CherryVelvetX reserves the right, but does not undertake a general obligation except where required by law, to review, restrict, disable, reject, or remove content that violates these Terms, applicable law, or CherryVelvetX policies.

CherryVelvetX may temporarily restrict content while investigating a complaint, consent dispute, copyright claim, performer-verification issue, or suspected violation.

Creators remain responsible for the legality and authorization of their submissions regardless of whether CherryVelvetX reviews the content.

13. CONSENT AND CONTENT REMOVAL REQUESTS

CherryVelvetX may provide procedures through which an individual depicted in content can report unauthorized publication, lack of consent, or withdrawal of consent where applicable.

CherryVelvetX may temporarily disable disputed content while reviewing such a complaint.

Submitting intentionally false or fraudulent reports is prohibited.

Nothing in this section limits rights or remedies available under applicable law.

14. COPYRIGHT AND INTELLECTUAL-PROPERTY COMPLAINTS

CherryVelvetX respects intellectual-property rights.

Users may not upload content they do not own or have permission to distribute.

CherryVelvetX may remove or disable access to material following receipt of a valid copyright complaint and may terminate accounts belonging to repeat infringers under appropriate circumstances.

Copyright complaints should identify the copyrighted work, identify the allegedly infringing material, provide sufficient information to locate the material, provide appropriate contact information, and contain the statements and signature required by applicable law.

CherryVelvetX may maintain a separate Copyright/DMCA Policy containing the designated contact information and complete notice procedure.

15. ACCOUNT SUSPENSION AND TERMINATION

CherryVelvetX may suspend, restrict, or terminate an account when reasonably necessary because of:

• violation of these Terms;
• illegal activity;
• suspected CSAM or exploitation;
• failure of age or identity verification;
• copyright infringement;
• fraudulent activity;
• unauthorized content;
• threats to Website security;
• abuse of other users; or
• conduct creating material legal or security risk for CherryVelvetX.

CherryVelvetX may remove associated content when an account is terminated.

Where appropriate and legally permissible, CherryVelvetX may provide notice of an enforcement action.

16. FEES

CherryVelvetX may offer certain Website functionality without charging creators or users.

CherryVelvetX reserves the right to introduce paid services, premium features, advertising products, or other fees in the future.

Any applicable fee, payment obligation, refund rule, or revenue arrangement will be disclosed before the user becomes obligated to pay it.

Unless expressly stated otherwise, CherryVelvetX does not acquire a percentage of a creator’s revenue generated independently through third-party subscription or payment platforms merely because the creator promotes those services through CherryVelvetX.

17. USER REPRESENTATIONS AND WARRANTIES

By using CherryVelvetX, you represent and warrant that:

• information you provide is accurate and current;
• you have legal authority to enter into these Terms;
• your use of CherryVelvetX complies with applicable law;
• you will not interfere with the Website’s security or operation; and
• you possess the necessary rights and permissions for anything you upload.

Creators additionally warrant that all adult performers appearing in their submitted content satisfy the age, identity, consent, and authorization requirements established by these Terms and applicable law.

18. DISCLAIMER OF WARRANTIES

These obligations survive termination of your account where permitted by applicable law.

Use of CherryVelvetX is also subject to the CherryVelvetX Privacy Policy.

22. RECORDKEEPING AND LEGAL COMPLIANCE

Where applicable, creators must maintain records, identification documents, performer releases, and other documentation required by law.

CherryVelvetX may separately maintain records required of the Website or its operator under applicable law.

Nothing in these Terms should be interpreted as transferring a creator’s independent legal or recordkeeping obligations to CherryVelvetX.

23. CHANGES TO THE SERVICE

CherryVelvetX may modify, suspend, discontinue, add, or remove Website functionality at any time, subject to applicable law.

CherryVelvetX does not guarantee that any particular feature, creator page, advertising program, or service will remain available permanently.

24. ASSIGNMENT

You may not assign or transfer your rights or obligations under these Terms without CherryVelvetX’s prior written consent.

CherryVelvetX may assign its rights and obligations in connection with a merger, acquisition, restructuring, sale of assets, change of control, or other lawful business transaction, subject to applicable law.

25. SEVERABILITY

If any provision of these Terms is determined by a court of competent jurisdiction to be invalid or unenforceable, that provision shall be enforced to the maximum extent permitted by law or severed where necessary.

The remaining provisions shall remain in full force and effect.
